What to do when you get a HIT on your NBI clearance


In applying for the new 2014 NBI clearance, you have to be at your chosen NBI kiosk as early as 4am just so you'll be in the first 500 applicants. For those who will get the numbers 501 and up, they have to come back the next day and fall in line again.

To catch the magic 500 line-up, you really have to wake up at around 3 o'clock in the morning just so you'll be there on time.

Here's the catch.

Even if you do get a spot in the first list, what if you get a "hit" when you are already about to claim your clearance.

Civil Cases Not Included.

When you get a "hit" it means that either you have a namesake or you may have a pending criminal case in court.

For your peace of mind, civil cases such as money claims, ejectments, annulments, etc. are not included.

However, the "hit" entitles you to a two-week waiting time. That is the length of time that NBI researchers will verify if the name on the "hit" list is really you or if you still have any other pending cases. So, if you got "hit" - for example on the 20th of June - you'll be asked to go back on the 4th of July.

Quality Control is at NBI Taft Avenue.

When you return on July 4, if your clearance is still not available, the clerk at the counter will now tell you to proceed to NBI Main along Taft Avenue, Manila so you'll be interviewed by their Quality Control staff.

Be Patient!

You really have to go to Manila.

You can get there either by riding the LRT for twenty pesos, or driving all the way via Espana Boulevard, left to Lacson (formerly Forbes) then right towards Paco.  At the end of the road is Taft corner UN Avenues.  The NBI Main Office.

Because you are going to Quality Control, you must enter the left wing gate and proceed to the line which says "QC".

Of course, there's a line waiting for you so you have to be patient. Bring an iPod or laptop with you.  Tinker into anything versus boredom. When you hear your name in the PA system, stand up and approach the QC interviewer.

Sworn Affidavit for Namesake Issues, Disposition Clearance for Pending Cases

If you have a namesake, there is an NBI in-house lawyer whom you will be asked to subscribe upon. You will be executing an affidavit and attest under oath that what appeared on their record is just your namesake.

It's an affidavit, a legal instrument, that's why Mr. Lawyer is there to put his signature into.

Now, if you really do have a pending case, you will be asked to proceed to the court of origin and apply for a Disposition Clearance.

You cannot get your NBI clearance yet.

The problem is, what if your warrant isn't lifted yet?  Will NBI agents suddenly swarm at you and arrest you?

Probably not because they don't have the actual warrants with them. And they don't know if such warrants are still active or not. What they have there are just a list of names of people with pending cases. If you're a bit skeptic, you can send a representative in your behalf.  Give your rep an Authorization Letter and at least two of your valid ID's.

Go to the court of origin

So, how do you go about the Disposition Clearance?  Do you have to talk to the judge?  Do you have to get a lawyer?  Will you be spending money?  What if the warrant still stands, will you be arrested in court?

If you do have a pending warrant, then you might want to post for your bail.  The case won't move unless you post bail and be arraigned. Now, if you have already posted bail before and is awaiting final judgment, communicate with the Clerk of Court. Of course, there is now a very slim chance to get a clearance if the cases are still active.

Now, if the case is already over, get a copy of the judge's "Decision" and see if the case against you is already dismissed. If yes, then immediately ask a for a Disposition Certificate from the Clerk of Court. If not, then I'm afraid you have to serve sentence.
